Aura Studio NYC Participant Agreement

DBA/Studio Name: Aura Studio NYC Membership, Cancellation, and Billing Policy

By electronically agreeing to this waiver, I acknowledge and agree to the following terms:

Membership Commitment:
All Memberships require a minimum 3-month commitment.  Early cancellation prior to completing three months will not be permitted unless agreed upon in writing by Aura Studio NYC management.

Late Cancellation and No-Show Policy Late Cancellation:
If I cancel a class within 12 hours of the scheduled start time, I understand that:

*If I am an Unlimited Member, I will be charged a $35 late cancellation fee.


*If I am on the intro offer and no credit card is on file, the monetary equivalent of one full drop-in class ($35) will be deducted in the form of time removed from the duration of the intro offer.

*If I am using a class credit or drop-in, I will lose that credit without refund.

Billing Authorization
I authorize Aura Studio NYC to automatically charge my stored payment method for any membership fees, late cancellation fees, no-show fees, or other incurred charges.

Refund Policy
Aura Studio NYC does not offer refunds on memberships, packages, or class credits.
If a cancellation or issue arises, a credit may be issued to my account at the studio’s sole discretion, allowing me to apply the credit toward a future class or service.
Credits must be used within 6 months of the date they were issued, or, for active members, before the end of your current billing cycle.


Cancellation of Membership
I must provide at least 30 days’ written notice (email acceptable) to cancel my membership. I am responsible for any charges incurred during this notice period.

Force Majeure
Aura Studio NYC shall not be liable for any failure or delay in performing services due to acts beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, governmental actions, labor strikes, or power failures.

Photography and Videography
Aura Studio NYC may occasionally photograph or film classes for marketing or promotional purposes. By participating, I grant Aura Studio NYC permission to use my likeness without compensation.

 If I do not wish to appear in any media, I will notify the instructor prior to the start of class.

Liability Waiver, Release of Liability, and Assumption of Risk Agreement
Voluntary Participation & Assumption of Risk

I voluntarily choose to participate in yoga, pilates, meditation, breathwork, sound healing, or any other activity offered by Aura Studio NYC (Stanev McGinn Corp), whether on-site or off-site. 

I understand these activities involve inherent and unforeseen risks, including but not limited to physical injury, emotional distress, or illness (including COVID-19). 

I knowingly and voluntarily assume all such risks and accept full responsibility for any resulting loss, injury, damage, or harm.

Medical Fitness
I certify that I am physically and mentally fit to participate. I have consulted with a physician where appropriate. I will not hold Aura Studio NYC or any of its owners, directors, employees, or contractors (“Releasees”) responsible for my participation.

Release and Waiver of Liability
I release, waive, discharge, and covenant not to sue Aura Studio NYC or any Releasees from any liability, claims, demands, or causes of action related to my participation, except for acts of gross negligence or intentional misconduct as prohibited by New York law.Indemnification
I agree to indemnify, defend, and hold harmless Aura Studio NYC and the Releasees against any claims, damages, or expenses (including attorney’s fees) arising out of my participation or actions.

Emergency Medical Care
I authorize Aura Studio NYC to obtain emergency medical care for me if necessary and agree that any expenses incurred are my responsibility.

Attorney’s Fees and Costs
If I bring legal action against Aura Studio NYC and the claim is unsuccessful or dismissed, I agree to be responsible for all associated legal fees and costs.

Booking for Others
If I book for another person or a group, I confirm that I have authority to agree to these terms on their behalf and will ensure they comply with studio policies.

Use of Essential Oils and Aromatherapy
I acknowledge that essential oils may be used in classes. I will notify the instructor if I have sensitivities. I voluntarily assume all risks associated with exposure.

Outdoor Classes in Public Parks
I understand that outdoor classes may occur in public spaces, such as Central Park, not affiliated with Aura Studio NYC. I waive liability against any municipal or park entity.

Severability & Governing Law
If any part of this agreement is deemed invalid, the rest shall remain effective. This agreement is governed by the laws of the State of New York. Any legal proceedings must be brought exclusively in New York County.

Acknowledgment of Understanding
I affirm that I have read, understood, and voluntarily agree to the terms of this Participant Agreement.

I am of legal age and understand that by clicking “I Agree,” I waive certain legal rights, including the right to sue.
